Privacy Notice

 1. What appears in this Privacy Notice?

This Privacy Notice explains how Adidas collects and uses information that you have provided to us and that can be used to directly or indirectly identify you (“Personal Information”) for the purpose of administering membership in the adiClub Club.

They are known as Adidas' “joint supervisors” in the GDPR documents and in local privacy laws. They are jointly responsible for determining why (“Purpose”), how (“Processing”), and if (“Legal Basis”) we use your Personal Information. In this Notice we refer to them as the “Responsible Entities” to make it easier for you to understand this.

For some scenarios described in this notice, there may be other Adidas and/or non-Adidas entities that are also responsible for the use of your Personal Information, see the specific scenario for more information.

As the principal institution under the GDPR, Adidas AG is primarily responsible for determining the strategy for regulation compliance and implementing the necessary technical solutions to help you exercise your rights. This is the primary point of contact for any questions about this Notice or how Adidas uses and protects your Personal Information in all EU/EEA countries, as well as in the UK and Switzerland.

Note: Subject to the European Data Protection Regulation (“EU GDPR”), the responsible companies identified in this section are known as “data controllers.”

3. What does Adidas do with your Personal Information and why (categories of Personal Information, purpose, processing, legal basis)?

 Adidas collects and uses the Personal Information that your adiClub membership includes for the following purposes:

1. Compliance with the terms and conditions for membership in the Club; and

2. Creating a profile for content, experience, marketing and business analyses, and targeted marketing messages that are personalized.

1. Compliance with the terms and conditions of club membership

Processing

When you apply and create a club membership account, we collect and use your Personal Information to manage your account and to comply with the adiClub Terms and Conditions.

This includes the following:

a. Collection, storage and processing of Personal Information provided by you on the registration form to create a club membership profile and an account for you;

b. Assigning a club member ID to your profile and account and using the club member ID along with any other identifying information that you provided for your identification;

c. Storing login information for your club membership account on our global verification platform to enable you to access all suitable platforms of Adidas (Adidas website, app, Adidas Confirmed Running app, and Adidas Training app (with the same login information);

d. Viewing your current club membership status, including profile information, level, points, and other relevant information across all of Adidas’ domains and apps;

e. Sending messages pertaining to the management of club membership by email, including messages regarding account status (level up and/or down), management (benefits opened for you and how to retrieve them) and maintenance requests (for example, password reset);

f. Sending messages about club membership management  by push notifications in Adidas apps about your account status (level up and/or down), management (benefits opened for you), and maintenance requests (e.g. password reset) - you can disable push notifications at any time through your mobile device settings. However, if you disable push notifications, we may need to contact you by email in cases of important notices related to your membership in the club;

g. Verifying and using your profile and account information for the purpose of participating in sweepstakes and/or exclusive challenges - this will also include sharing your contact information with partners who support us in managing the sweepstakes, especially in the event that you win a prize;

h. Calculating your club points for redeeming benefits - this will include sharing your information with partners who support us in managing the benefits, where the benefit can be obtained through a partner or exclusively by the partner;

i. Updating the status of your points after you used the points to redeem the benefits;

j. Tracking your activity and redemption history;

k. Providing access to special offers and promotions;

l. Sending invitations to exclusive events;

m. Providing access to limited edition products;

n. Providing the basic features of Adidas’ running and training apps (subject to change) as part of the club membership offer;

o. Providing access to the premium features of Adidas’ running and training apps that are offered as a benefit for club membership in accordance with the membership terms;

p. Providing access to the Adidas running and training premium features through a subscription purchased from adidas International Digital Sports GmbH.

q. Saving your delivery address and payment information to shorten checkout time on the website and the app;

r. Saving your full order history so that you can access it at any time;

s. Allowing you to track the delivery of your order from your account;

t. Option to access the club membership profile and provision of services and support – including updating your account information according to your instructions, providing support and answering questions about your account, your purchases, technical support for using our apps, support for questions about your privacy - when you contact Adidas through various communication channels through the Club Membership ID and Profile;

u. Storing all of the Personal Information that we collect directly or indirectly from you identified by your Member ID or email with your membership profile, including information you may have shared in an Adidas brand retail store and in Adidas outlet and franchise stores, which are used to calculate points and levels to enable all of the above; and

v. Sharing information about management of club membership with partners and receiving shared data from partners of the adiClub, for the purpose of accumulating points and benefits as specified in the Terms and Conditions - this is solely based on your explicit consent at the time when the data is collected by partners adiClub; if you wish to stop sharing data with the partner of adiClub or with Adidas, your consent can be withdrawn at any time.

2. Creating a profile for content, experience, marketing and business analysis purposes and targeted marketing messages, which are personalized.

Processing

We use your Personal Information to create personalized content for you and to ensure that our communication with you increases the likelihood that you will continue to be a member of the club, that you will respond to our targeted marketing messages and that you will continue to purchase Adidas products and use the Adidas platforms.

This includes the following:

Sending personalized emails about how to score points in the club or maintain your level, including promotional messages about Adidas products, services and lifestyle recommendations - you can unsubscribe from this message at any time by using the “unsubscribe” function in the message;

 Sending push notifications through Adidas apps about how to earn points in the club or maintain your level, including promotional messages about Adidas products and services and fitness and lifestyle recommendations - you can disable push notifications at any time through your mobile device settings. However, you may still receive emails that can be unsubscribed from directly in the emails;

Tracking and monitoring your online browsing behavior by various means as described below (if you have logged in and consented to our use of certain tracking technology on our website and apps, including the use of cookies, pixels, tags);

Storing all of the Personal Information we collect directly or indirectly from you that was identified through the membership ID or email with your membership profile, including information you may have shared in an Adidas brand retail store and in Adidas outlet stores and franchises for the purposes of calculating points and levels, and using them to enrich your membership profile as described below; and

Analyzing and evaluating all of the Personal Information that we collect directly or indirectly from you that is identified by your membership ID or email with your membership profile, including information you may have shared in an Adidas brand retail store and in Adidas outlet stores and franchises. More specifically, this includes using your personal information in the following ways:

Cookies and tracking technologies

Upon your first visit to the site, you will be asked to accept, reject and/or customize the types of cookies and tracking technologies that are not necessary for the proper operation and security of the site, i.e. "Cookies and Other Tracking Technologies" that can be installed on your computer according to categories (analytics, advertising, etc.). Web beacons and Tracking Links

Web beacons (also known as pixel tags and clean GIFs) include graphics that are not visible to the user. Tracking links and/or similar technologies consist of several lines of programming code that can be embedded on the website. In combination with cookies, these are mainly used for statistical analysis purposes.  In addition, we embed pixels of various companies, such as Facebook, TikTok and Humanz on our websites and apps to record user interaction with parts of them as well as to understand usage patterns and measure the success of our marketing campaigns outside of the websites and apps and whether they led to sales and/or registration for our customer clubs/apps.

In addition, in general, this technology can also be used to track patterns of activity on the website, as well as to find out if an email has been received and opened and to check whether there has been any response.

Traffic analysis (web analytics)

Traffic analysis is the term given to the method for collecting and evaluating the behavior of visitors to websites and apps. This analysis includes analyzing traffic patterns to, for example, determine the frequency of visits to certain parts of the website, or to find out what information and services visitors are more interested in than others. For these purposes, we primarily use clickstream data and the other techniques listed above. Website analytics is performed by Google Analytics and/or other selected entities. Creating a Profile (Audience Management)

We create a profile for you by combining all of the information you provide to us directly or indirectly. This allows us to have a personalized interaction with you based on our past interaction and other information we can use to infer what you like or dislike. We use crowd management technologies to ensure that the right messages and information reach you at the right time through the right channel. This includes sending marketing messages about deals and products or reaching out to you across the digital media through adverts on Adidas brand platforms. The level of customization depends on the approval you have given us.

Marketing Analysis

We use your data for various analytics purposes to better understand: a) how you browse and use our platforms; b) what products you are interested in; c) what features of our products and platforms you like; d) the quality of our services, including customer service, marketing and advertising campaigns that appeal to you, and your response to these services; e) the design of our products and website; and whether or not the overall user experience suited you. We use this analysis to improve the relevance of the marketing messages we send to you and the quality of our personalization experience across our various channels and platforms.

Data Enrichment

We create one cohesive customer profile by matching any Personal Information that allows you to be identified. This includes Personal Information that we collected from you directly or indirectly across digital media or offline, from your feedback to us, from your interaction and communication with us through our various platforms and communication channels.

Improving Data Models

We use data science and your profile and Personal Information to create data models that can help us improve the logic of our analytics activities and give us more insight into your comments and feedback, interactions, and preferences and needs regarding our products and services. We will compare the data model we have created using your profile with similar categories and profiles of other customers in order to continue to predict and analyze your preferences.

What happens when Adidas transfers your Personal Information outside of your country of residence?

A) Contracts

Adidas signs appropriate contracts and/or contractual clauses to ensure that the privacy standard we set is upheld when we share your Personal Information with other Adidas companies and third parties located within or outside your country of residence. This includes: inter-company agreements, data processing agreements, data transfer agreements or data privacy clauses approved by regulatory authorities such as EU standard contractual clauses approved by the European Commission.

Adidas has sufficient data security controls to address the risks and vulnerabilities connected to our use of your Personal Information, including loss, alteration or unauthorized access to your Personal Information as a result of malicious intent (hacking) or negligence (human error).
